D
Deviation

On a motion pending twenty-three months, Judge Felix ordered three years of mandatory disclosure from the bench. Asked by Wife's lawyer, "And that's the Court ruling on Dock 22?", he answered: "Correct." He entered no written order.

E
Expected output

A court speaks through its written orders; an oral grant never entered cannot be enforced or appealed. Having ordered disclosure from the bench on a motion filed May 16, 2024, and confirmed it was "the Court ruling on Dock 22," Judge Felix enters a written order with the 30-day deadline he set, and sets any objection for the hearing he promised.

  • Apr. 17, 2026: "So I'm going to order three years of mandatory disclosure going back three years from the date of the filing initial petition on January 26th 2024." Then: "I'm not going to preclude any objections to that. You can make your objections and we'll set that for a hearing specifically." And: "I didn't order this discovery and say you have to produce -- you don't -- I'm not precluding any right to make an objection, all right, and then we'll have to deal with that specifically." Husband: "they're not going to produce anything. They're going to kick the can down the -- further down the road". The court: "I appreciate your concern. Noted. We'll cross those bridges when we get there. 30 days?" N-090

I
Independent encounter

Judge Matthew Felix (the bench ruling; no written order). Scott Davis, Wife's counsel (raised the agreements; "I understand the Court's ruling."). One motion, one hearing, one ruling never written. Every duty here arises from the court's own oral order and due process on this motion alone; no other card is needed to establish it.

L
Law: the authority that creates the duty

Art. I, ss. 9 and 21, Fla. Const. guarantee due process and justice without delay. Rule 2.215(g)(1): "Every judge has a duty to enter within a reasonable time an order or judgment on every matter submitted to that judge." A ruling announced from the bench and never reduced to writing cannot be enforced under Rule 12.380 or reviewed on appeal.

What happened

On 4/17/26, after 23 months, Judge Felix orally ordered three years of Rule 12.285 disclosure. He set 30 days but left Wife free to object, after her counsel raised the prenuptial and postnuptial agreements, and said: "I didn't order this discovery and say you have to produce -- you don't -- I'm not precluding any right to make an objection." He entered no written order. Later the same day, asked about the same motion, he said: "We already handled that matter." No written ruling exists in the record. Nothing was produced in the 30 days the court set, or since. When Husband moved in July 2026 simply to have that bench ruling reduced to writing, that motion drew no order either (N-133). [WON-THEN-NULLIFIED]

The baseline

A court that grants a motion to compel compels something. Rules 12.285 and 12.350 exist so a party owed financial disclosure gets it. Here disclosure was ordered from the bench, every objection was left open, and nothing was written down. A court speaks through written orders, so an oral grant never entered cannot be enforced or appealed. The motion is the first-filed motion in the case (N-003).

The mechanism

after 23 months the motion was finally heard and granted from the bench, and the grant moved nothing: the court said, "I didn't order this discovery and say you have to produce -- you don't -- I'm not precluding any right to make an objection," and entered no written order.
